What pushes us so far that we fall back on a lawsuit? A profound need for justice. The feeling that we’ve been played, robbed, hurt, betrayed and that someone needs to pay for it. What can we win? Our case, to which we attribute a certain dollar value. We can also win recognition from family, friends, clients and associates. Finally, you can win the satisfaction of defending righteous cause and being vindicated.

You can also lose this and so much more.

It’s true, the worst-case scenario does exist: having won your cause but lost everything in the process: Financially, personally, professionally. After all the years of a judicial saga, often there isn’t much left.

We speak today of participatory justice, mediation, asking for help from a third party, often a lawyer, to help resolve a conflict. Yes, but, perhaps with a lawyer open to this approach?

Qu’est-ce qui peut nous pousser à intenter une poursuite?  Un profond besoin de justice. Le sentiment d’avoir été floué, volé, trahi, blessé tellement qu’on a besoin de dénoncer et que justice soit rendue. Qu’est-ce qu’on peut gagner? Notre cause à laquelle est peut-être associé un montant d’argent. On peut aussi gagner une certaine reconnaissance de sa famille, de ses amis, de sa clientèle, de ses associés. Enfin, on pourra avoir la satisfaction d’avoir défendu une cause juste, et que la justice nous ait donné raison. On peut aussi perdre tout ça et plus. En effet, le pire scénario existe, celui d’avoir gagné sa cause et d’avoir en même temps tout perdu : financièrement, personnellement, professionnellement. 

Car après des années de saga judiciaire, souvent il ne reste plus grand-chose.On parle aujourd’hui de justice participative, de médiation, supposant l’aide d’une tierce personne, très souvent un avocat, pour aider à dénouer le conflit. Oui, mais… Peut-être avec un avocat ouvert à cette approche?

Est-ce que le fait de se connecter à son intelligence pour rejoindre celle de la partie adverse pourrait suffire?

Avant de tout perdre pour gagner… pourquoi ne pas l’essayer? Et rien n’empêche de se faire aider par une personne de confiance quand les émotions deviennent trop fortes et risquent de tout faire basculer.
